Owners of Vacant Apartments in Munich Now Face Fines of Up to €200,000

Property owners in Munich who leave residential units vacant without a valid legal reason now face substantial financial penalties.

The city administration has reported on a series of completed administrative offense proceedings. The city’s Social Services Department has recently imposed fines totaling €230,000.

These cases involve various vacant properties: an apartment (€22,000), a townhouse (€10,000), a single-family home (€35,000), and an apartment building where four units were left empty (€164,000).

Mayor Verena Dietl commented: “Every apartment matters in a city where so many people are searching for affordable housing. That is why we are consistently tackling the illegal withdrawal of housing from the market—our determined actions have already led to 202 residential units being returned to the market. This proves that such measures work. Anyone who leaves living space vacant without good reason must expect serious consequences.”

According to the administration’s explanation, a fine is typically imposed after the completion of proceedings to establish the misuse of the property, once all key stages, evidence gathering, and decision-making are final. The amount of the fine is always dependent on the severity of the offense (for example, the size of the apartment and the duration of the vacancy), the nature of the charges, and the financial situation of the offender. “Therefore, the fine is always determined by the specific circumstances of each individual case.”

The Social Services Department stated that it intends to continue consistently applying all legally available enforcement measures and sanctions in the future. The goal is to preserve Munich’s housing stock by preventing and penalizing the illegal non-use of residential spaces.
