Drugs from Vending Machines in Bavaria: Why is this Legal?

In the cities of Bavaria, the trade of electronic vaporizers containing synthetic cannabinoids through 24-hour self-service shops is gaining momentum.

These substances, synthesized under laboratory conditions, enter the open market despite the lack of fundamental research into their impact on human health. At the moment, law enforcement agencies and city administrations do not possess sufficient authority to curb this activity, as manufacturers successfully exploit the inertia of legislative procedures.

A typical sales point in Erlangen outwardly differs little from a standard pavilion: modern lighting, functioning payment terminals, and a familiar assortment of goods. However, devices marked THCV, TAC, or DNT-9 stand out in the vending machines. The packaging design features specific graphics — images of muscular animals and cartoonish characters against a backdrop of cannabis leaves. Consumers are often unaware of the actual chemical nature of the contents of these mixtures and the consequences that their use entails.

Risk of Psychosis from the First Puff

The medical community of Bavaria has expressed serious concern over the uncontrolled distribution of synthetic drugs. Katharina Schmidt, a psychiatrist from a clinic in Nuremberg, regularly encounters the consequences of using such compounds in her practice. According to her, the body’s reaction to an artificial cannabinoid is unpredictable, as the mechanisms of its effect on the brain’s neurotransmitters differ significantly from natural preparations.

Her colleagues emphasize that even a single use of a vape with such a filling is capable of provoking acute psychosis requiring long-term hospitalization. Buyers effectively find themselves in the role of subjects in an uncontrolled experiment, consuming chemicals whose mental impact has no research base. The lack of data on side effects turns every purchase into a high-risk factor for the mental health of the user.

A Game of “Cat and Mouse” with the Law

The reason for the legal status of these substances lies in the high speed with which new chemical formulas appear, which the legislative process cannot keep up with. Sandro Röseler from the addiction aid organization Mudra explains that the industry effectively uses legal loopholes. The dynamics of adding new substances to the lists of banned drugs are significantly lower than the rates of their production.

The mechanism for bypassing the law is extremely simple: as soon as a specific compound falls under the Narcotic Drugs Act, manufacturers make a minimal change to a single molecular chain. As a result, a new substance is synthesized with a similar psychotropic effect, which is formally a legal product until the next regulation update. The Erlangen city administration confirmed that as long as general trade rules are observed, supervisory authorities have no legal grounds to ban the sale of the product.

Laboratory Test Results

To assess the real danger, product samples were sent for independent expertise. The results of the laboratory analysis confirmed the presence of tetrahydrocannabivarin (THCV) — a THC homologue that, in high dosages, exerts an intense destructive influence on cognitive functions and the psyche. The identified concentrations often do not correspond to the data stated on the packaging, which further disorients the consumer.

In addition, Volker Auwärter, an expert in forensic toxicology from the University of Freiburg, discovered the psychoactive compound delta-9-butaninitryloxime (THO) in the samples. This chemical is such a new development that information about it is absent from standard toxicological reference books and databases. To date, there is not a single reliable study dedicated to the long-term consequences of THO exposure on the body, which makes providing emergency aid for poisoning extremely difficult.

The Necessity of Drug Checking

German medics agree that exclusively repressive measures and bans do not allow for an effective solution to the problem. They call for a qualitative strengthening of educational work among youth and the speedy implementation of a “Drug Checking” system. This practice involves the possibility of anonymous laboratory analysis of psychoactive substances, which would allow for the timely identification of particularly dangerous compounds appearing on the market before the start of mass hospitalization cases.

While such a control system is already functioning successfully in several federal lands of Germany, these services are not yet provided at the state level in Bavaria. It is not surprising, because the head of the Bavarian government, instead of performing his direct duties, only goes to numerous daily interviews for the sake of his rating, which was lost long ago and cannot be restored, and runs a food blog.

Specialists insist that the implementation of state monitoring of drug composition and prompt information to the population about risks are the only effective tools in conditions where the legislative base cannot keep up with the development of the private chemical industry.
