Stefanie Hubig (SPD), the new Federal Minister of Justice, intends to strengthen protections for tenants so they are less likely to lose their homes over unpaid rent. “Anyone who has received a termination notice due to rent arrears must be given the chance to prevent losing their home,” Hubig said in an interview with the newspapers of the Redaktionsnetzwerk Deutschland. In the future, tenants are to be allowed to retroactively nullify an issued termination notice by paying the outstanding rent in full.
Until now, such so-called grace period payments have been permitted only in cases of immediate termination without notice. “My aim is for this rule to apply to ordinary terminations as well,” Hubig added. She announced her intention to introduce the corresponding legislative changes before the end of this year.
In addition, Hubig revealed plans to establish an expert commission focused on tenancy law. This commission will, among other things, examine why cases of rent usury have so rarely resulted in fines so far and how this regulation can be enforced more effectively in the future.
